Terms of service / Allgemeine Geschäftsbedingungen (AGB)

1. Scope / Geltungsbereich
These terms apply to all orders placed by consumers and businesses with Papital Gallery e.U., Groner Str. 12, 37073 Göttingen, Germany (“we”, “us”) through this online shop. Consumers are natural persons acting for purposes outside their trade or profession (§ 13 BGB).

2. Contract / Vertragsschluss
The presentation of products in the shop is an invitation to order, not a binding offer. By clicking the order button you make a binding offer to buy the items in your cart. We accept the offer by sending an order confirmation by email or by shipping the goods, whichever is first. The contract language is English or German.

3. Prices and payment / Preise und Zahlung
All prices are in euro and include the statutory German VAT. Shipping costs are shown separately before you complete your order. We accept the payment methods shown at checkout (e.g. credit card, PayPal, Klarna, Shop Pay, Apple Pay, Google Pay). Payment is due when you place the order.

4. Delivery / Lieferung
We ship from Göttingen, Germany, to the countries listed at checkout. Delivery is made at the latest within 30 days of acceptance of your order unless a different date is agreed. For deliveries outside the EU, import duties and taxes may apply and are borne by the recipient. For consumers, the risk of loss passes only when the goods are handed to you.

5. Retention of title / Eigentumsvorbehalt
The goods remain our property until paid in full.

6. Right of withdrawal / Widerrufsrecht
Consumers have a statutory 14-day right of withdrawal. The full withdrawal notice and the model withdrawal form are set out in our Return and refund policy.

7. Warranty / Gewährleistung
Statutory warranty rights apply (for consumers 2 years from delivery). Our pieces are handmade from clay tile, glaze and metal components; small variations in colour, glaze and shape are characteristic of handmade work and are not defects. Please keep jewellery away from water, perfume and cosmetics and store it in its pouch.

8. Business customers / Geschäftskunden
Wholesale orders are subject to our separate wholesale terms and price list. Wholesale customers can request access at papital.gallery/pages/wholesale.

9. Dispute resolution / Streitbeilegung
The European Commission’s online dispute resolution platform has been discontinued (20 July 2025). We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

10. Applicable law / Anwendbares Recht
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law does not deprive you of the protection of mandatory provisions of the law of the country in which you habitually reside.
